TERMS AND CONDITIONS (AGB)

1. Scope of Application and Contractual Partner
These General Terms and Conditions (hereinafter "Terms") apply to all contracts, services, and deliveries concluded between you as the customer and Tatiana Streichert (operator of the business names "Streichert-Fotografie" and "Edit by Love / Creative Studio", address as stated in the Legal Notice / Impressum, hereinafter "Provider") via this website or through other means of communication.
This offer is directed at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity pursuant to § 13 BGB (German Civil Code).

2. Scope of Services
The Provider offers services and products in two main areas:
  • Digital Products and Design: Creation, personalization, and provision of digital invitation cards as well as related design services. All products in this area are purely digital. No physical shipping will take place.
  • Photography Services: Conducting photo shoots, image editing, creation of photography products, and provision of the final image files.

3. Ordering Process and Conclusion of Contract
  • For digital invitations: The customer selects a design template and submits the required data via the personalization form. The presentation of the designs on the website does not constitute a legally binding offer, but rather an unbinding online catalog. By submitting the order, the customer makes a binding offer. The contract is only concluded upon explicit confirmation by the Provider via email.
  • For photography services: The contract is concluded upon written or email confirmation of an individual offer or the firm booking of a shooting appointment.

4. Project Workflow and Correction Rounds
  • Digital invitations: Upon receipt of all data, the Provider will send an initial draft within 48 to 72 hours. The price includes correction rounds regarding texts and minimal layout adjustments. Subsequent, profound structural change requests after the start of processing may incur additional costs. After final approval by the customer, the final link will be provided.
  • Photography: The selection of images and the style of editing are at the artistic discretion of the photographer, unless otherwise agreed upon in writing. Correction rounds refer exclusively to technical defects and do not apply to the artistic style.

5. Provision and Deadlines
  • The final digital invitations are provided to the customer in the form of a shareable link. This link remains active for a period of 3 months after the specified event date, starting from the day of approval. The customer is solely responsible for permanently securing the data.
  • The finished photo files are provided to the customer via email in the form of a link to a cloud storage. This link and the access to the images in the cloud storage are valid for exactly 1 month from the time of provision.

6. Prices and Payment Terms
  • The prices stated on the website at the time of the order or the prices of the individual offer apply.
  • Note on Value Added Tax (VAT): Due to the application of the small business regulation (Kleinunternehmerregelung) pursuant to § 19 UStG (German Turnover Tax Act), no value added tax is charged and consequently not displayed on invoices.
  • Payments for digital products must be made in advance. For photography services, a deposit upon booking may be agreed upon.

7. Right of Withdrawal and its Exclusion
  • Exclusion for digital invitations: Since the personalized invitation cards are digital contents that are not delivered on a tangible medium, and which are furthermore manufactured according to customer specifications and clearly tailored to the personal needs of the customer, there is no right of withdrawal pursuant to § 312g Abs. 2 Nr. 1 BGB once the Provider has started processing and personalization.
  • Photography services: For contracts regarding services related to leisure activities, there is no right of withdrawal if the contract provides for a specific date or period for the provision pursuant to § 312g Abs. 2 Nr. 9 BGB. The cancellation conditions for shoots are governed by the respective individual offer.

8. Copyright and Usage Licenses
  • All designs, layouts, graphics shown on this website as well as the photos created during shoots remain the intellectual property of Tatiana Streichert.
  • Upon full payment, the customer is granted a simple, non-transferable, temporally unlimited right of use for purely private purposes.
  • Commercial use, resale, duplication, or editing of the designs and photos for commercial purposes is prohibited without the express written consent of the author.

9. Customer Content and Third Party Rights
  • The customer bears sole responsibility for all content such as texts, photos, graphics, or music tracks that they provide to the Provider for the personalization of invitations or for photo projects.
  • The customer warrants that they hold all necessary rights to the materials provided. The Provider is not obliged to check these materials for rights violations.
  • Special rule for music: The integration of music files into digital invitations takes place exclusively if it is provably royalty-free music or if the customer confirms in writing that they possess the necessary rights of use for this purpose.

10. Warranty and Limitation of Liability
  • The Provider is liable according to the statutory provisions for damages resulting from injury to life, body, or health, as well as for damages based on an intentional or grossly negligent breach of duty.
  • For slight negligence, the Provider is only liable in the event of a breach of essential contractual obligations. In this case, liability is limited to the contract-typical, foreseeable damage.
  • The Provider assumes no guarantee for an uninterrupted availability of the website or the provided invitation link in the event of server failures of third-party providers.

11. Final Provisions and Applicable Law
  • The law of the Federal Republic of Germany applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
  • Should individual provisions of these Terms be or become ineffective, the effectiveness of the remaining provisions shall remain unaffected.
